CAEplex’ Privacy Policy

Your privacy is very important to us at Seamplex.1 Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal and professional information. We want to transparently convey to you our responsibilities regarding the information you generate when you use the CAEplex service (the “Service”).

When we say “personal information” in this Privacy Policy, we mean information that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about you that is associated with or linked to any of the foregoing information. When we use the phrase “anonymous information” in this Privacy Policy, we mean information that is not associated with or linked to your personal information. Anonymous information does not enable identification of or contact with individual persons.

Besides personal information, we might have access to “professional information” regarding the information contained in the projects you create using CAEplex (i.e. the CAD geometry, the problem conditions, the mesh, etc.). There exist two kind of projects in CAEplex, namely public and private. The information contained in public projects is made available under the terms of the Creative Commons Attribution 4.0 International License for anyone in the internet, including search engines and people that do not have an account in CAEplex. Even though public access is read only, nothing prevents the reader to make a copy (e.g. clone the CAEplex project) and make modifications to such copy. On the other hand, private projects can only be accessed (either read only or with read/write permissions) to those CAEplex users you designate.

1 Information and data policy

The following outlines our privacy policy.

  1. Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.
  2. We will collect and use of personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.
  3. We will only retain personal information as long as necessary for the fulfillment of those purposes.
  4. We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
  5. Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
  6. We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification.
  7. We will make readily available to customers information about our policies and practices relating to the management of personal information.

We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained.

Should you wish we permanently delete you personal information from our records, please contact us. We will happily do so, as we already have for many of our (former) registered users.

1.1 Information collection

When you access and use the CAEplex service, we collect and receive the following kinds of personal information:

  1. Account and profile information: When you create your CAEplex account, you are required to give us your full name, a chosen password and a valid email address. We may ask for additional information from time to time in order to create a more robust user profile. This additional information is optional.
  2. Communications: When you communicate with us by sending us an email, we will collect and store any information that is contained in your communications with us.

We collect the following types of anonymous information:

  1. Log data: When you use CAEplex, our system automatically records information including information that your browser sends whenever you visit a website. This log data may include your Internet Protocol (IP) address, the address of the web page you visited before arriving at CAEplex, your browser type and settings, the date and time of your request, information about your browser configuration and plug-ins, language preferences, and cookie data.
  2. Device information: In addition to log data, we may also collect information about the device on which you are accessing CAEplex, including what type of device it is, what operating system you are using, device settings, unique device identifiers, and crash data. Whether we collect some or all of this information often depends on what type of device you are using, and its settings.
  3. Geo-location information: the IP addresses received from your browser or device may be used to determine your approximate location.
  4. Usage data: This is information about how you use the various capabilities and features of the CAEplex service. We use this information to better understand opportunities to improve the quality of the service we provide to you.
  5. Information from partners or other third parties: CAEplex may receive information from partners or others to help make our own information better or more useful. For example, CAEplex’s use Google Analytics to upload information about which features you use, but that information will never be connected to your identity, your devices, or your documents.

1.2 Information usage

We may use your information for the following:

  1. Providing the CAEplex service: We use information you provide to authenticate you, and enable you to use our cloud-based CAE platform, collaboration, storage and other services.
  2. Compliance and investigations: We reserve the right to use data in connection with suspected inappropriate use, fraud, violations of CAEplex’ Terms and Conditions, or any other activity that threatens to impede CAEplex’ and/or its users’ ability to use the Service efficiently and effectively.
  3. Communicating with you: We will occasionally send you tailored communications based on information you include in your profile, or your use of the Service. You can manage the frequency and/or opt out of receiving these communications by changing your settings on the “Account” page and/or clicking the “Unsubscribe” link at the bottom of each email. We also will send you service and administrative emails (for example notices of changes in the Terms and Conditions, this Privacy Policy or in the Pricing and Plans page), for which you may not opt out.

Generally, we use anonymous information in statistical analysis to help us analyze patterns in the use of our Service. We may, through our use of cookies, keep you logged into our website, collect your page visits, tailor web content to you and personalize your experience on the website. We may also use your anonymous information to improve our internal operations, and notify visitors of updates to our Service.

2 Non-disclosure

We are committed to keeping your information secure and secret. We will not disclose neither your personal information nor the files associated to your account (i.e. geometries, projects, reports, etc.). See our Security measures for technical details. 3 Security measures

Our servers run updated versions of the Debian GNU/Linux distribution with all the standard security measures and patches installed.

The data transmitted between your computer, laptop, mobile phone or table and our servers (including but not limited to personal and financial information, CAD geometries and other electronic files, etc.) is encrypted using Transport Layer Security. If at any time you see that the protocol connection is http instead of https (note the ending s), do not continue using the website and inform us as soon as possible. This encryption layer is known as end-to-end encryption and is the state-of-the-art method of making secure connections over the Internet.

4 GDPR

The European Union’s General Data Protection Regulation, or GDPR, enhances the existing framework for companies that process the personal data of EU-based residents. It came into effect on May 25, 2018, bringing with it a host of new obligations for those companies, and new privacy rights for their end users. Processing data can mean many things, from collecting data to storing and using it. Organizations large and small that process the personal data of EU-based data subjects are now preparing for the new regulation.

Seamplex is committed to protecting the privacy and security of users’ data. We believe that GDPR complements our existing data protection policies and processes, giving us a solid foundation and helping us maintain a strong commitment to data privacy. 5 Cookies

Cookies are small data files that are placed on your computer or mobile device when you visit a website. Cookies are widely used by website owners in order to make their websites work, or to work more efficiently, as well as to provide reporting information.

Cookies set by the website owner (in this case, CAEplex) are called “first party cookies”. Cookies set by parties other than the website owner are called “third party cookies”. Third party cookies enable third party features or functionality to be provided on or through the website (e.g. like advertising, interactive content and analytics). The parties that set these third party cookies can recognize your computer both when it visits the website in question and also when it visits certain other websites.

We use first party and third party cookies for several reasons. Some cookies are required for technical reasons in order for CAEplex to operate, and we refer to these as “essential” or “strictly necessary” cookies. For example, some cookies are associated with your CAEplex account and personal information in order to remember that you are logged in. Other cookies are not tied to your CAEplex account but are unique and allow us to do site analytics and customization, among other things. Other cookies also enable us to track and target the interests of our users to enhance the experience on CAEplex. Third parties serve cookies through CAEplex for analytics and other purposes. The specific types of first and third party cookies served through CAEplex and the purposes they perform are described below. 5.1 Essential cookies

These cookies are strictly necessary to provide you with services available through CAEplex and to use some of its features, such as access to user accounts. Because these cookies are strictly necessary to deliver the Website to you, you cannot refuse them without impacting how CAEplex function.

5.2 Analytics and customization cookies

These cookies collect information that is used either in aggregate form to help us understand how CAEplex are being used or how effective our marketing campaigns are, or to help us customize CAEplex for you in order to enhance your experience.

5.3 Advertising cookies

These cookies are used to make advertising messages more relevant to you. They perform functions like preventing the same ad from continuously reappearing, ensuring that ads are properly displayed, and in some cases selecting advertisements that are based on your interests.

5.4 Google Analytics

CAEplex uses Google Analytics, a web analysis service provided by Google Inc. (“Google”). Google Analytics uses cookies. The information generated by the cookie concerning your use of this website (including your IP address) will be transmitted to the United States to a Google server and stored there. Google will use this information to analyze your use of the website, compile reports on website activities for the website operators, and to provide other services connected with website and Internet use. Google, too, will transmit this information to third parties as necessary, to the extent this is required by law or to the extent third parties process the data on Google’s behalf. You can prevent installation of the cookies by adjusting the settings of your browser software accordingly; please note, however, that you might then be unable to fully use all functions of this website. 6 Changes to the Privacy Policy

We reserve the right, at any time in our sole discretion, to modify or replace any part of this Privacy Policy, without prior notice. We will prominently notify you of any updated policies by posting them on CAEplex.com so that they are accessible via a link from the home page, and/or to send you an email to the last email address you provided to us. If you continue to use CAEplex after any changes are in effect, you will be deemed to agree to the revised policy. If you object to any such changes, your sole recourse is to cease using the service.
